Consultation response to the draft executive order on exemption of port and airline companies from the Act on Openness in Public Administration

Danish Ports would like to thank you for the opportunity to provide comments on the draft executive order exempting port and aviation companies from the Act on Public Access to Administration.

General remarks
The Danish commercial ports are large, active business areas and home to a broad value chain of companies and related industries within, among other things, transport, logistics, energy, supply and defense.

The commercial ports create growth and development through a wide range of commercial services in connection with the operation and development of port infrastructure and energy infrastructure, the development of dry ports in the ports' hinterland areas, and the rental of port facilities in connection with port-related activities.

Danish ports are commercial and competitive enterprises that operate on market terms within the given regulatory framework. In order to optimize their business and create value for society, ports must have the right opportunities and incentives to deliver the development and transformation of the ports that the market demands.

Specific comments
Exemption of the companies Taulov Dry Port Holding A/S, Port House A/S and ADP Energy Infrastructure A/S from the Act on Public Administration means that the companies in question and ADP A/S, which owns the companies in question, can act on commercial terms in the development of their respective commercial businesses, which benefits growth and development as well as job creation locally and regionally.

On this basis, Danish Ports supports the legislative amendment.

It is further proposed that Lindø Port of Odense A/S in §1 no. 12 be changed to Odense Havn A/S, as the company has changed its name.
