Consultation on the Concessions Directive
Danish Ports wants confirmation that the Concessions Directive will not affect Danish port practice The Concessions Directive regulates the conclusion of concession contracts, i.e. contracts in which a private actor is granted the right to perform a specific task and to the earnings that this may entail, e.g. the construction of a bridge and the associated bridge tolls. The Concessions Directive is a brand new directive and thus has no current case law. In Denmark, the directive is to be implemented directly into Danish law.
Danish Ports finds it very positive that the Danish Competition and Consumer Authority has chosen to conduct an AMVAB measurement in connection with the implementation of the Concessions Directive and recommends including commercial ports in the measurement.
Danish Ports assess that the Concession Directive will not affect the conclusion of lease contracts between publicly owned ports and private companies in Denmark. This is to be confirmed by the Danish Competition and Consumer Authority.
