Does the sale of the land need to be approved?
The municipal port is part of the municipal administration and is subject to the applicable guidelines.
In an autonomous port, the authority to buy and sell real estate etc. will normally be delegated to the port board unless otherwise stipulated in the port's statutes. It is the responsibility of both the municipal council and the port board to safeguard the interests of the port when selling port areas.
Although the limited liability company port does not need to have its sales approved beyond what may be determined by the general meeting and board of directors, it should be noted that the municipality, when establishing the limited liability company, may have conditioned its right of first refusal on the sale of land.
