Does a port area have to be put out to public tender for sale?
In the case of a municipal port, the answer is generally yes. The same guidelines apply as if it is the municipality that wants to sell real estate. The detailed rules can be found in Executive Order no. 799 of June 24, 2011.
However, if the area belongs to a self-governing port or a municipally owned port company, there is no requirement for the port to put the area out to tender. The Ministry of the Interior confirmed this in June 2010. The port can therefore sell the area in the traditional way via a real estate agent.
